Auch wenn das Interesse an Nachrichten aus Brexitannien abgenommen haben dürfte, sollte der Fall Stephen Gough doch nicht in Vergessenheit geraten.
Inzwischen ist ein zweiter Anlauf vor dem Europäischen Gerichtshof für Menschenrechte gestartet worden, diesmal geht es um die Vereinbarkeit von der ASBO-Verhängung mit der Meinungsfreiheit. "The Times" hat darüber berichtet, allerdings mit Bezahlmauer, immerhin ist der Anfangsteil lesbar, daraus:

Das Problem mit dem Artikel 10 ist die Einschränkungsmöglichkeit der Meinungsfreiheit zugunsten der "Moral", ein Griff in den Nebel, siehe:

Hinzu kommt inzwischen das Problem, daß es dort künftig wohl nicht mehr besonders interessiert, was Europäer zu Menschenrechtsfragen auf einer fernen Insel meinen.
Es gibt die gute Nachricht, daß Stephen Gough weiterhin berechenbar tickt und seine gebrechliche Mutter pflegt und deshalb Verhaftungsrisiken durch Bekleidung aus dem Weg geht, wie aus folgendem Artikel einer Rechtsanwältin und Journalistin hervorgeht:

... COMPLAINT The applicant alleges that the imposition of the ASBO breached his rights under Article 10 of the Convention. He argues that its only purpose was to circumvent the maximum penalties permitted for public nudity by the Public Order Act and that, as a result, it did not pursue a legitimate aim. He further argues that it was neither necessary nor proportionate since it conferred no further powers on the police to deal with his behaviour and constituted a blanket prohibition on public nudity, removing any police and prosecutorial discretion. The consequence of the imposition of the ASBO was automatic prosecution and imprisonment indefinitely and in conditions akin to solitary confinement. This was disproportionate to the prevention of a low-level, non-imprisonable public order offence. Further, the terms of the order were wide and ambiguous, so that it was impossible to enforce it consistently within the prison system.
